SERVICE TERMS & CONDITIONS

The following terms apply to all consultations, digital products, creative services, and projects booked through GTB Studio.

16. Booking Procedure

To begin a project, clients must first contact GTB Studio to discuss their project requirements and determine the most appropriate service.

Following this discussion, clients will receive a private booking link or invoice where applicable.

A project is considered officially booked only once:

  • Payment has been successfully received.

  • Any required agreements have been accepted.

  • All requested project information has been submitted.

GTB Studio reserves the right to refuse or decline any booking at its sole discretion.

17. Payments

Unless otherwise agreed in writing, all services require payment before work begins.

For selected larger projects, GTB Studio may offer an agreed payment schedule at its sole discretion.

All prices displayed on our website or quoted directly are subject to change until a booking has been confirmed.

Any applicable transaction fees, currency conversion charges, taxes, customs fees, or payment processing fees remain the responsibility of the client unless otherwise stated.

Work will not commence until payment has been successfully received.

Failure to complete payment may result in cancellation of the booking.

18. Project Start

Your project officially begins only after:

  • Payment has been received.

  • All required project information has been submitted.

  • GTB Studio confirms your booking.

Any delays in providing requested information may delay your project’s estimated start date and delivery timeline.

19. Information Required From Clients

Depending on the selected service, clients may be asked to provide:

  • A project brief

  • Inspiration or reference images

  • Brand guidelines

  • Logos

  • Measurements or sizing information

  • Colour preferences

  • Fabric preferences

  • Technical requirements

  • Manufacturing requirements

  • Timeline expectations

  • Any additional information necessary to complete the project

Clients are responsible for ensuring that all submitted information is accurate and complete.

Incomplete or incorrect information may delay the project or affect the final outcome.

20. Project Timelines

Estimated project timelines are provided as a guideline only and are based on the information available at the time of booking.

While GTB Studio makes every reasonable effort to complete projects within the estimated timeframe, delivery dates are not guaranteed.

Project timelines may be affected by factors including, but not limited to:

  • Delays in receiving required information or materials from the client.

  • Changes to the project scope.

  • Revision requests.

  • Client response times.

  • Third-party services or manufacturers.

  • Unforeseen circumstances beyond our reasonable control.

Where significant delays occur, GTB Studio will communicate an updated estimated delivery timeframe.

21. Project Scope & Additional Work

Each project is completed according to the service purchased and the scope agreed upon before work begins.

Any request that falls outside the original project scope may be considered additional work and may require:

  • A revised quotation.

  • An additional payment.

  • An updated delivery timeline.

GTB Studio reserves the right to determine whether a request falls outside the original scope of work.

Work outside the agreed scope will not begin until both parties have agreed to the additional services.

22. Revisions

Unless otherwise stated in your selected service, revisions are limited to those included within the purchased package.

A revision refers to adjustments made to the existing approved concept and does not include the creation of entirely new concepts, designs, or directions.

Requests for significant redesigns, additional concepts, or major changes after approval may be treated as a new service and quoted separately.

To avoid delays, clients are encouraged to submit clear and consolidated revision requests whenever possible.

23. Client Responsibilities

Clients agree to:

  • Provide complete and accurate project information.

  • Respond to requests for feedback within a reasonable timeframe.

  • Review deliverables carefully before providing approval.

  • Ensure they have the legal right to use any logos, images, artwork, trademarks, or materials supplied to GTB Studio.

  • Communicate respectfully and professionally throughout the project.

GTB Studio shall not be responsible for delays, inaccuracies, or additional costs resulting from incomplete information, incorrect instructions, or materials provided by the client.

24. Communication

All official project communication will take place through the communication channels agreed upon at the beginning of the project.

To ensure accuracy and maintain project records, GTB Studio may request that important approvals, revisions, or instructions be confirmed in writing.

Our studio operates Monday to Friday, excluding weekends and public holidays.

Messages received outside of these business hours will be answered as soon as reasonably possible during the next business day.

While we aim to respond promptly, response times may vary depending on our current workload.

25. Project Delays & Client Inactivity

Clients are expected to provide requested information, approvals, and feedback within a reasonable timeframe.

If a client becomes unresponsive or fails to provide the information necessary to continue the project, GTB Studio reserves the right to place the project on hold until communication resumes.

Projects delayed due to client inactivity may be rescheduled according to our current production schedule.

Extended periods of inactivity do not entitle the client to a refund or priority scheduling once the project resumes.

26. Rush Services

Where availability permits, GTB Studio may offer expedited or rush services for an additional fee.

Acceptance of a rush project remains entirely at GTB Studio’s discretion and depends on our current workload and production capacity.

Rush services do not reduce the quality or scope of the work provided but prioritize the project’s position within our production schedule.

27. Project Cancellation

Clients may request to cancel a project at any time by contacting GTB Studio in writing.

If work has not yet commenced, GTB Studio may, at its sole discretion, determine whether any payment is eligible for a partial refund, taking into account any administrative work, consultation, scheduling, or preparation already completed.

Once work has begun, cancellations do not automatically entitle the client to a refund.

GTB Studio reserves the right to cancel or decline a project where circumstances make it unreasonable or impossible to continue the professional working relationship. In such cases, any appropriate refund will be determined based on the work completed at the date of cancellation.

28. Refund Policy

Due to the custom and creative nature of our services, all projects are scheduled specifically for each client and require dedicated time, planning, and creative development.

For this reason, all payments are generally non-refundable once work has commenced.

Refunds will not be issued for:

  • Change of mind.

  • Failure to use purchased services.

  • Delays caused by the client.

  • Dissatisfaction arising from personal preference after the approved scope has been delivered.

  • Failure to provide required project information.

  • Requests that fall outside the agreed project scope.

Where exceptional circumstances arise, GTB Studio may review the situation on a case-by-case basis. Any refund granted shall remain entirely at the sole discretion of GTB Studio unless otherwise required by applicable law.

Nothing in this Refund Policy limits any statutory rights that cannot legally be excluded under applicable consumer protection laws.

29. Client Approval

Throughout the project, clients may be asked to review and approve concepts, sketches, layouts, technical documents, branding elements, or other deliverables before work progresses to the next stage.

Once written approval has been provided by the client, the approved work shall be considered accepted.

Any subsequent changes requested after approval may be treated as additional work and may require additional fees and revised delivery timelines.

Final approval confirms that the client has reviewed the work carefully and is satisfied for the project to proceed or be completed.

30. Intellectual Property

Unless otherwise agreed in writing, all preliminary concepts, drafts, sketches, working files, creative processes, unused concepts, research, and development materials remain the intellectual property of GTB Studio.

Upon full payment, the client receives the rights to use the final deliverables for the purpose agreed upon within the purchased service.

Ownership or transfer of copyright, source files, editable files, or exclusive intellectual property rights shall only occur where expressly agreed in writing.

GTB Studio reserves the right to retain ownership of all underlying creative methods, templates, processes, techniques, and know-how developed during the project.

31. Portfolio & Marketing Rights

Unless otherwise agreed in writing or where confidentiality has been specifically arranged, GTB Studio reserves the right to display completed work for portfolio, website, social media, marketing, competitions, publications, educational, and promotional purposes.

This may include displaying completed designs, branding, technical work, illustrations, AI visuals, or other creative deliverables.

Where confidential or unreleased projects are involved, GTB Studio will respect any written confidentiality agreement accepted before the project begins.

32. Confidentiality

GTB Studio respects the confidential nature of our clients’ projects.

Any confidential business information, concepts, product ideas, documentation, or project materials shared with GTB Studio will be treated with reasonable care and will not be intentionally disclosed to third parties without the client’s permission, except where required by law or necessary to complete the agreed service.

Likewise, clients agree not to share GTB Studio’s proprietary methods, templates, educational materials, internal documents, pricing structures, workflows, or confidential business information without prior written permission.

33. Manufacturer & Third-Party Services

GTB Studio may provide manufacturer pairing, supplier recommendations, sourcing assistance, or introductions to third-party service providers as part of certain services.

While we make every reasonable effort to recommend manufacturers and suppliers that we believe are reliable, GTB Studio does not own, manage, supervise, or control any third-party manufacturer or supplier.

Clients remain solely responsible for:

  • Selecting their preferred manufacturer or supplier.

  • Reviewing quotations and agreements.

  • Approving samples before production.

  • Verifying measurements, materials, colours, and specifications.

  • Communicating directly with third-party providers where required.

GTB Studio shall not be responsible for manufacturing defects, production delays, quality issues, shipping delays, pricing changes, customs fees, communication issues, business decisions, or any other actions or omissions of third-party manufacturers, suppliers, or service providers.

34. AI Visuals & Digital Content

Some services provided by GTB Studio may include AI-generated visual concepts, campaign imagery, mock-ups, or other digital content.

Unless otherwise stated, these visuals are intended for presentation, concept development, marketing, and creative visualization purposes only.

Clients acknowledge that AI-generated visuals may differ from the final manufactured product and should not be interpreted as exact production references unless specifically stated.

GTB Studio is not responsible for variations between AI-generated concepts and final manufactured products.

35. Business Results Disclaimer

GTB Studio provides professional creative, consulting, and fashion development services designed to support our clients’ businesses and creative projects.

However, we do not guarantee any specific commercial outcome, including but not limited to:

  • Product sales

  • Investor interest

  • Manufacturing acceptance

  • Retail opportunities

  • Financial success

The success of a business depends on numerous factors beyond the services provided by GTB Studio, including market conditions, pricing, marketing, operations, competition, and the client’s own business decisions.

36. Limitation of Liability (Services)

To the fullest extent permitted by applicable law, GTB Studio’s liability in connection with any service provided shall be limited to the amount paid by the client for the specific service giving rise to the claim.

GTB Studio shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to:

  • Loss of profits

  • Loss of revenue

  • Loss of business opportunities

  • Loss of goodwill

  • Manufacturing losses

  • Delayed product launches

  • Third-party costs

  • Consequential commercial losses

Nothing in these Terms excludes or limits liability where such limitation is prohibited by applicable law.

37. Chargebacks & Payment Disputes

Clients agree to contact GTB Studio first if they have any questions or concerns regarding their order or project before initiating a payment dispute or chargeback.

Because all services provided by GTB Studio are custom-made and created specifically for each client, clients acknowledge that work may begin shortly after payment has been received.

Clients agree not to initiate chargebacks or payment disputes for work that has already been started, partially completed, or delivered, except where such rights cannot legally be waived under applicable law.

In the event of a payment dispute or chargeback, GTB Studio reserves the right to submit all relevant evidence in support of its position, including but not limited to:

  • Invoices

  • Payment confirmations

  • Email correspondence

  • Project briefs

  • Revision history

  • Messages

  • Progress updates

  • Delivered files

  • Screenshots

  • Any other relevant project documentation

Nothing in this section limits any statutory consumer rights that cannot legally be excluded under applicable law.

38. Force Majeure

GTB Studio shall not be held responsible for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to:

  • Natural disasters

  • Fire or flood

  • Government restrictions

  • War or civil unrest

  • Epidemics or pandemics

  • Internet or power outages

  • Cybersecurity incidents

  • Serious illness or medical emergencies

  • Transportation disruptions

  • Failure of third-party services

  • Any other unforeseen event beyond our reasonable control

Where reasonably possible, GTB Studio will inform clients of any significant delays and provide an updated estimated timeline.

39. File Delivery & Storage

Final project files will be delivered electronically using the agreed delivery method.

Clients are responsible for downloading, reviewing, and securely storing all delivered files upon receipt.

GTB Studio will retain completed project files for approximately 90 days following final delivery. While we make reasonable efforts to maintain project archives during this period, permanent storage cannot be guaranteed.

After this period, project files may be permanently deleted without further notice.

Should a client request previously delivered files after the retention period, GTB Studio cannot guarantee that such files will still be available.

40. Website Content & Digital Products

All content displayed on the GTB Studio website, including but not limited to text, graphics, branding, service descriptions, layouts, downloadable resources, educational materials, and digital products, remains the intellectual property of GTB Studio unless otherwise stated.

Digital products, templates, guides, worksheets, and educational materials purchased from GTB Studio are licensed for the purchaser’s personal or internal business use only.

Without prior written permission from GTB Studio, clients may not:

  • Copy or reproduce digital products.

  • Share purchased materials with third parties.

  • Resell or redistribute any digital product.

  • Upload purchased materials to public platforms.

  • Modify our digital products for resale or redistribution.

Unauthorized use may result in the termination of access and, where permitted by law, legal action.

41. Changes to These Terms

GTB Studio reserves the right to update or modify these Terms & Conditions at any time.

Updated versions become effective immediately upon publication on our website unless otherwise stated.

Clients who have already booked a service will remain subject to the version of these Terms & Conditions accepted at the time of booking, unless both parties agree otherwise or applicable law requires a different approach.

42. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the country in which GTB Studio is legally established.

43. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

Failure by GTB Studio to enforce any provision of these Terms shall not constitute a waiver of any rights under these Terms.

44. Entire Agreement

These Terms & Conditions constitute the entire agreement between GTB Studio and the client regarding the use of our website, digital products, consultations, and creative services.

They supersede any previous discussions, representations, communications, or agreements relating to the same subject matter unless expressly agreed otherwise in writing.
